FedEx Leads Legal Challenge

On February 23, 2026, FedEx officially filed a lawsuit against the US government, seeking a full refund for duties paid under the Trump administration’s recent tariff policies. The move follows a landmark 6-3 Supreme Court ruling that found the president overstepped his authority by using emergency powers to bypass Congress’s sole power to levy taxes.

While the court’s decision stopped the specific enforcement mechanism, it left the status of the estimated $175 billion already collected in limbo. As the first major carrier to seek reimbursement, FedEx’s legal challenge could set a precedent that could affect the logistics industry and thousands of other importers currently navigating a volatile trade environment.

Profound Impact of Supreme Court Ruling

The Supreme Court’s ruling has significant implications for US trade policy. The court determined that tariffs imposed under the International Emergency Economic Powers Act (IEEPA) exceeded executive authority. This ruling not only affects the 10% tariffs imposed on China, but also extends to tariffs on Asian export powerhouses from South Korea to Japan and Taiwan.

China’s Ministry of Commerce stated it is making a full assessment of the US Supreme Court tariff ruling, noting that “fighting is harmful.” This statement reflects both sides’ recognition of the negative impact of trade friction on global supply chains.

Tariff policy uncertainty has brought enormous challenges to the logistics industry. According to Logistics Viewpoints, the supply chain landscape in the final week of February 2026 is defined by a massive push to bridge the gap between having data and actually using it.
